By accessing the website at https://tonicpow.com, or any tonicpow.com sub-domain, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use License

1. Permission is granted to temporarily download one copy of the materials (information or software) on TonicPow's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
   1. modify or copy the materials;
   2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
   3. attempt to decompile or reverse engineer any software contained on TonicPow's website;
   4. remove any copyright or other proprietary notations from the materials; or
   5. transfer the materials to another person or "mirror" the materials on any other server.
2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by TonicPow at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

TonicPow makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
2. Further, TonicPow does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

1. In no event shall TonicPow or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on TonicPow's website, even if TonicPow or a TonicPow authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
2. TonicPow is not responsible for any tax payment on the amounts received from TonicPow. It is the user's responsibility to declare their taxes.
3. TonicPow is not liable for any kind of delays or failures that are not directly related to TonicPow and therefore beyond our control.
4. TonicPow reserves the right to alter these terms at any time, including but not limited to earning amounts or rules.

5. Accuracy of Materials

The materials appearing on TonicPow's website could include technical, typographical, or photographic errors. TonicPow does not warrant that any of the materials on its website are accurate, complete or current. TonicPow may make changes to the materials contained on its website at any time without notice. However, TonicPow does not make any commitment to update the materials.

6. Links

TonicPow has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by TonicPow of the site. Use of any such linked website is at the user's own risk.

7. Modifications

TonicPow may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Delaware and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

9. Promoter Accounts and Links

Promoter links must be organically consumed. The visitor must be aware of the campaign being shared which includes but is not limited to: title of campaign, context of campaign, and custom message about the campaign.

TonicPow reserves the right to mark as INVALID any and all traffic which TonicPow considers to be fake or of abusive nature. Any amount earned through fraudulent means will be deducted from your account or withdrawal.

The following are our Promoter Account and Link Sharing restrictions:

1. Sharing links in public or private chatrooms such as Facebook Groups, Discord, Telegram, or any other group messaging platform, application, or client is prohibited unless all of the following conditions are met:
   • The group is private, and has 50 members or less.
   • The link is shared with appropriate context or provides an unfurled view, as always.
   • Sharing in any such groups is disclosed during withdrawal request (if applicable).

   OR

   • The channel is on-chain using an open protocol.
   • The post is signed with a Bitcoin Identity matching your TonicPow promoter account ID (BAP ID).
   • The link is shared with appropriate context or provides an unfurled view, as always.
   • Sharing in any such groups is disclosed during withdrawal request (if applicable).
2. Simulating user clicks, conversions, sharing, or otherwise interacting with your unique promoter links.
3. Using any software to automatically view or visit promoter links.
4. Using proxies, VPN, or any other form of malicious means for accessing your account.
5. Purchasing interactions, or using other methods of sharing that encourage low quality engagement.
6. Using any illegal means to promote your link(s), including but not limited to: sending unsolicited emails, spamming, hacking, or defrauding other sites.
7. Sharing a link with no information or incorrect information for the visitor.
8. Spamming, or sharing multiple links within one page or message.
9. Using social accounts featuring exclusively, or predominantly sponsored content.
10. Multiple accounts from the same person, computer, and/or internet connection.
11. Violating the terms of service, or policies of any website, social network, application, or mobile app while sharing TonicPow links.

Violations of any above terms will result in either payouts being disabled, refunded, or account termination.

10. Traffic Quality

As a promoter, it is your responsibility to maintain a high level of traffic quality. This will happen naturally if you are sharing links organically, providing appropriate context to your links, and following the guidelines outlined in these terms.

If your traffic patterns are significantly out of normal bounds, or the traffic sources feature predominantly sponsored content or otherwise violate the link sharing terms outlined in section 9, your account may be suspended or terminated without prior notice.

11. Adult Content

Campaigns featuring nudity are prohibited. Sharing links on sites featuring adult content is also prohibited.

12. Prohibited Jurisdictions

You are not allowed to access or use the TonicPow Services if you are located, incorporated, or otherwise established in, or a citizen or resident of: (i) Cuba, Crimea and Sevastopol, Iran, Syria, North Korea, Sudan, or Russia; (ii) any state, country, or other jurisdiction that is embargoed by the United States of America; (iii) a jurisdiction where it would be illegal according to applicable law for you (by reason of your nationality, domicile, citizenship, residence, or otherwise) to access or use the TonicPow Services; or (iv) where the publication or availability of the TonicPow Services is prohibited or contrary to local law or regulation, or could subject any member of TonicPow to any local registration or licensing requirements (together, the "Restricted Jurisdictions").

TonicPow may, in its sole discretion, implement controls to restrict access to the TonicPow Services in any of the Restricted Jurisdictions. If TonicPow determines that you are accessing the TonicPow Services from any Restricted Jurisdiction, or have given false representations as to your location of incorporation, establishment, citizenship, or place of residence, TonicPow reserves the right to close any of your accounts immediately and refund any pending payments.

13. Other Restrictions

Campaigns featuring targeted harassment, or the encouragement of violence, or otherwise illegal content is strictly prohibited. Sharing links on websites featuring illegal content is prohibited. We reserve the right to terminate services for any reason.

14. Bitcoin SV Payments

All payments on the TonicPow platform are made in Bitcoin SV (BSV). The value of BSV may fluctuate, and TonicPow is not responsible for any changes in the value of BSV before, during, or after a transaction. Campaign budgets and payout rates are denominated in BSV unless otherwise stated. Once a payout has been sent to a promoter's wallet, the transaction is final and cannot be reversed.

15. Account Termination

TonicPow reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform will immediately cease. Any pending payouts may be withheld if there is a reasonable suspicion of fraud or violation of these terms.
